Terms of Service

DEFINITIONS:

Artist means Nida Farooqui and any qualified employee, assistant, or subcontracted artist authorized to perform services on behalf of Nida Farooqui.

Client means the individual booking the services and any person receiving services under the booking.

Retainer means the non-refundable and non-transferable payment required to reserve the requested appointment date and time.

Event Date means the wedding or event date specified on the booking confirmation.

Agreement means the entirety of these Terms of Service.

KEY BOOKING POLICIES:

  • All rates listed are quoted in CAD and are subject to HST
  • Prices are subject to change at any time. Rates are only guaranteed if specified on the estimate provided to you or if a retainer has been received for your services.
  • To secure a date and time, 40% retainer will be charged at the time of booking. For email agreements, the client is responsible for transferring the retainer via EMT to info@nidafarooqui.ca.
  • BOOKING RETAINER PAID IS NON-REFUNDABLE and NON-TRANSFERABLE. It is earned immediately upon receipt and is applied toward the total contracted amount.
  • Once the booking retainer is received, the requested date and time are reserved for the Client. The Artist declines other bookings for that period and this compensates the artist for reserving exclusive availability and lost business opportunities. Once confirmed, pricing for contracted services is guaranteed. Additional services requested after booking will be billed at the Artist’s current pricing.
  • Booking Times: Bridal hair and makeup require a minimum of 3 hours. Where a photographer has been arranged by a Client to come in getting ready shots, extra time must be booked at the time of booking. You may add this service to your existing booking by sending an email to info@nidafarooqui.ca or by adding it to your booking when booking online. Party makeup and hair service typically take 45-50 minutes, so when reserving your services, book accordingly.
  • Makeup and hairstyling will be completed to client’s satisfaction, but the service time will not exceed the allotted time. Ample time is given for each makeup and hair service upon booking. Any concerns must be raised during the appointment so reasonable adjustments can be made. Acceptance of completed services confirms satisfaction.   • Party services cannot be booked for brides. The artist reserves the right to cancel booking and the client will forfeit any retainer amount paid. If the artist agrees to provide services, the appropriate bridal fee will be charged before the commencement of the services.
  • The remaining balance must be paid before services begin.
  • The Artist is not responsible for the loss of, theft of, or damage to the Client’s personal belongings, including but not limited to: jewelry, veils, hair accessories/extensions, electronic devices, handbags, clothing, or other personal property.

EXCLUSIVE RESERVATION OF DATE:

  • Once the required retainer has been received, the Artist reserves the requested date and time exclusively for the Client. Because only one wedding can be accepted during the reserved time, the Artist declines all other inquiries and potential bookings for that period.
  • Accordingly, the Client acknowledges that the retainer represents payment for reserving exclusive availability and compensates the Artist for lost business opportunities. Therefore, the retainer is earned immediately upon receipt and is non-refundable and non-transferable, regardless of cancellation, postponement, change of plans, relationship status, venue changes, scheduling conflicts, or any other circumstances.

DELAYS & LATE FEES

  • Client delays of more than 30 minutes may result in additional fees or reduced services. Delays caused by photographers, videographers, family members, venues, or other vendors do not extend the Artist’s booked service time.

CANCELLATION

  • All retainer monies paid by Client are non-refundable and non-transferable. If the client cancels the booking/appointment after the retainer monies have been paid, the client will forfeit the retainer paid.
  • Postponement or rescheduling of event is considered a cancellation of the original booking. The original booking retainer is forfeited. Any new date constitutes as a new booking and is subject to availability, current pricing, and a new booking retainer. If the Artist is not available for the requested new date, this does not entitle the Client to a refund of transfer of the original booking retainer.
  • In the event of a wedding cancellation due to a state of emergency (e.g., natural disaster or global pandemic), we will allow a full transfer of the retainer to a new date within the same calendar year. However, we must be consulted to choose a suitable date. If you select a date when Nida Farooqui (or her agents) are unavailable, the retainer will be forfeited.
  • The Client agrees that all payments made under this agreement are made in consideration of the Artist reserving exclusive availability and providing the contracted services. The Client agrees not to initiate a credit card chargeback, payment reversal, banking dispute, or other payment recovery process unless the artist has materially failed to perform the contracted services under this Agreement. If a payment dispute is initiated, the Artist reserves the right to provide this Terms of Service Agreement, booking records, invoices, correspondence, payment confirmations, photographs, and any other relevant documentation to the financial institutions or payment processors in response to a payment dispute.

CHANGING THE NUMBER OF SERVICES:

  • Once the retainer is paid, no services may be removed from the booking. Removing services will result in the loss of the retainer for those services. The retainer is non-refundable and non-transferable under any circumstances.
  • Additional makeup requests outside of the original booking will be at the discretion of the makeup artist/hairstylist. All clients must be present at the scheduled time and location.
  • If the Client fails to notify Nida Farooqui of cancelled party services 24 hours prior to the commencement of appointment, the original balance owing must be paid in full as per the original booking and number of services booked.
  • IF the Artist is unable to perform the services due to unforeseen circumstances, every reasonable effort will be made to provide a qualified replacement. If a replacement cannot be arranged, all monies paid will be refunded. This refund represents the Artist’s entire liability.

CLIENT RESPONSIBILITIES & ON-SITE SERVICE LOCATION REQUIREMENTS:

  • Clients must arrive with a clean face and completely dry hair unless otherwise agreed.
  • Clients must disclose allergies, skin sensitivities, recent cosmetic procedures and medical conditions that may affect the services.
  • Complete any facial treatments, waxing, threading, or tinting 72 hours before the appointment whenever possible.
  • The Artist reserves the right to refuse services where a contagious illness, lice, conjunctivitis, cold sores, influenza, COVID-19, or any condition posing a health risk is present.
  • The Client is responsible for safeguarding all personal belongings throughout the appointment and Event.
  • Unless otherwise agreed in writing, Clients are responsible for providing their own hair extensions that must be clean, dry, detangled, colour matched, and ready for installation before the Event.
  • For on-site appointments, the Client must provide a clean, safe, well-lit workspace with a table, chair, mirror and electrical outlet. Services will not be performed in bathrooms or unsafe or unhygienic environments.

TRAVEL & PARKING FEES

  • Any travel fees, parking, valet, tolls, accommodation, and venue access fees are the Client’s responsibility and will be included in the final bill paid on the day of the appointment unless otherwise stated in writing.

EXTRAS

  • Please review the add-on costs for all party/bridal appointments at the time of booking. For bridal bookings: If you have a photographer coming in to capture “getting ready” shots, this service will cost extra, and you will need to arrange this with us beforehand or book the appropriate package. In addition, we do not carry 100% human hair extensions. If required, please inform us at the time of the booking so we can arrange a colour matching appointment or discuss other options to ensure human hair extensions are available for the day of your booking.
  • A Bridal Trial appointment is strongly recommended for every bride. The purpose of the trial is to discuss your desired wedding look, evaluate your hair and skin, review inspiration photos, and finalize the hair and makeup design for your Event date. A bridal trial does not reserve your wedding date. Likewise, booking your wedding date does not automatically include a bridal trial unless specified in your booking. Bridal trials must be booked and are typically held several weeks before the Event date as they require dedicated time and preparation.
  • Where services are required to commence before the Artist’s standard operating hours, an Early Morning Fee may apply.
  • Touch-up services and Artist stay-on services are not included unless specifically listed in the booking confirmation. Touch-up services must be arranged at the time of booking.

FORCE MAJEURE

  • The Artist shall not be liable for delays or failure to perform service due to severe weather, natural disasters, government restrictions, power outages, transportation disruptions, or other events beyond reasonable control.

ARTIST RESPONSIBILITES

  • Services will be performed professionally using sanitized products and tools. Nida Farooqui reserves the right to assign another qualified artist where reasonably necessary.

ALLERGIES OR SKIN SENSITIVITIES

  • The Client must inform the makeup artist of any allergies or sensitivities to makeup or hair products before the appointment. Clients may bring their own products if needed. In the event of an allergic reaction or any other adverse skin reaction, Nida Farooqui or her agents will not be held responsible for any injury, illness, or damage.

FINAL PAYMENT

  • The remaining balance must be paid by e-transfer to info@nidafarooqui.ca the night before the event or in CASH (CAD) on the day of the event, prior to the start of the appointment. NO EXCEPTIONS. The makeup artist reserves the right to delay services until full payment is received.

PHOTOGRAPHY & MARKETING

  • By paying the retainer, the Client acknowledges, agrees, and consents to the Artist taking of photograph(s) and/or video during and/or after the services provided. The Client hereby grants the Artist the irrevocable and perpetual right, title and interest including without limitation, the perpetual right and permission to copyright and/or use, re-use, modify, duplicate, distribute, and/or publish in any way they see fit, without restriction, the Client’s name, face, image, likeness, statement and/or voice (collectively, the “Image”), in any media, portfolio, promotional marketing materials and/or social media capacity worldwide, without any compensation to the Client. The Client acknowledges that the Artist is and will be the sole owner of all rights in and to the Images or any material created in connection to the image. If the Client prefers not to have their photo or video taken, it is the Client’s responsibility to inform the Artist during the appointment.

By paying the retainer, The Client agrees that they have carefully read and understood the terms and policies abovementioned. The Client hereby forever releases and waives the right to bring any claims to Nida Farooqui or her agents, employees, or other representatives for personal injuries, death, disease, personal or property losses, or any other loss, including but not limited to claims of negligence and give up any claim to seek damages, whether known or unknown, foreseen or unforeseen. The Client understands that the retainer monies paid to secure the booking/appointment are non-refundable and non-transferable and Nida Farooqui or her agents, employees, or other representatives will not be liable.

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada. The parties agree that any legal proceeding arising from this Agreement shall be brought before a court of competent jurisdiction in Ontario, unless otherwise required by law.

The Client acknowledges and agrees that this Agreement may be accepted electronically. Payment of the Booking Retainer, completion of an online booking, or any other form of written confirmation by the Client shall constitute acceptance of these Terms of Service. The Client confirms that they have had sufficient opportunity to read, understand, and ask questions regarding this Terms of Service agreement before completing the booking.
